Donation Privacy Policy

Effective Date: August 23, 2026

1. Introduction

This Privacy Policy explains how the campaign to elect Lisa Kearns as Mayor of the City of Burlington (“the Campaign,” “we,” “us,” or “our”) collects, uses, discloses, and safeguards personal information when you make a donation through lisakearns.ca (the “Website”), including information the Campaign is required to report under the Municipal Elections Act, 1996 (Ontario) (the “MEA”). By making a contribution to the Campaign, you acknowledge that you have read and understood this Policy.

2. Who We Are

The Campaign is the registered municipal election campaign of Lisa Kearns, candidate for Mayor of the City of Burlington in the October 2026 Ontario municipal election. Questions about this Policy or about your personal information can be directed to the contact listed in Section 14.

3. Information We Collect

When you make a donation through the Website, we collect:

• Your full name
• Your mailing address
• Your email address
• Your telephone number, if you provide one
• The amount and date of your contribution
• Payment information, which is collected and processed directly by our payment processor, Square (see Section 6) — the Campaign does not receive or store your full card number

If you separately sign up for campaign updates or to volunteer, we also collect the name, email address, and other details you submit through those forms.

4. How We Use Your Information

We use the information you provide to:

• Process and record your donation
• Confirm receipt of your contribution and communicate with you about it
• Comply with our legal obligations under the MEA, including preparing and filing the Campaign’s financial statement with the City Clerk of Burlington
• Send campaign updates, where you have opted in to receive them, in accordance with Canada’s Anti-Spam Legislation (CASL)
• Confirm that a contribution complies with the eligibility and limit rules described in Section 5

5. Legal Disclosure Required Under the Municipal Elections Act, 1996

Ontario law places specific rules on who may contribute to a municipal candidate and requires certain contributor information to be made public. In particular:

• Only individuals who are residents of Ontario may contribute to the Campaign. Corporations and trade unions may not contribute.
• The maximum any one individual may contribute to the Campaign is $1,200, and no more than $5,000 in total to all candidates for Burlington City Council (including the office of Mayor) in this election.
• Contributions greater than $25 must be made by cheque, money order, credit/debit card, or another method that clearly identifies the source of funds; cash contributions are limited to $25.
• Any contributor whose total contributions to the Campaign exceed $100 will, by law, have their name and address included in the Campaign’s financial statement, which is filed with the City Clerk of Burlington and becomes a public record available for inspection, including online at the City’s discretion.
• If total contributions or expenses exceed $10,000, the financial statement must also be reviewed by an auditor.

This disclosure is a legal requirement of the MEA. It is not something the Campaign can waive, and it is not something a contributor can opt out of. Prospective contributors are encouraged to review the current Ontario Ministry of Municipal Affairs and Housing Candidates’ Guide and Contributors’ Guide before donating.

6. Payment Processing

Donations made through the Website are processed by Square, Inc. (“Square”), a third-party payment processor. The Campaign does not receive or store your full credit card number; Square handles payment card data in line with the Payment Card Industry Data Security Standard (PCI DSS). Square’s handling of your payment information is governed by Square’s own privacy policy, available at squareup.com/us/en/legal/general/privacy-no-account. We encourage you to review it before contributing.

7. How We Share Your Information

We do not sell, rent, or trade your personal information. We disclose personal information only:

• As required by the MEA, to the City Clerk of Burlington and, where applicable, an independent auditor (see Section 5)
• To service providers who help us operate the Website, process donations, or manage campaign communications (for example, Square, our email/newsletter platform, and our volunteer sign-up form provider), each of whom may use your information only to provide those services to the Campaign
• If required by law, by court order, or to protect the rights, safety, or property of the Campaign or others

8. Data Retention

We retain contribution records for as long as required under the MEA and any applicable municipal retention schedule following the election, and for as long as needed to support any compliance review or audit. Other personal information, such as newsletter sign-ups, is kept only as long as needed for the purpose it was collected, or until you ask us to remove it, whichever comes first. Information already included in a financial statement filed with the City Clerk is a public record and cannot be retroactively removed.

9. Security

We take reasonable administrative and technical steps to protect the personal information you provide, including relying on Square’s PCI DSS–compliant infrastructure for payment data. No online system is completely secure, and we cannot guarantee absolute security.

10. Your Choices and Rights

You may:

• Unsubscribe from campaign email updates at any time using the link in any email we send, or by contacting us directly
• Ask us to correct inaccurate contact information we hold about you
• Ask what personal information we hold about you and how it is used

Please note that we cannot alter or remove information that the MEA requires us to disclose publicly once it has been filed with the City Clerk.

11. Cookies and Website Analytics

The Website may use cookies or similar technologies, including those set by our website host, form providers, and Square’s checkout page, to help the site function and to understand how visitors use it. You can control cookies through your browser settings; disabling cookies may affect some features of the Website, including the donation checkout process.

12. Children’s Privacy

The Website and our donation process are not directed at children. We do not knowingly collect personal information from anyone under the age of 18.

13. Changes to This Policy

We may update this Policy from time to time, including to reflect changes in the MEA or in our own practices. The “Effective Date” at the top of this Policy shows when it was last revised. Material changes will be posted on this page.
